<span style="font-size: 16px;">根据《中华人民共和国民法典》的规定，电动自行车失火爆炸造成其他人的损失，电动自行车的所有权人、使用人或者管理人必须对损失进行赔偿。《民法典》第一千一百六十五条规定：“行为人因过错侵害他人民事权益造成损害的，应当承担侵权责任。”</span>

<span style="font-size: 16px;">本案中，电动自行车是停放在非专门用于停放的架空层处，而如果火情是由电动自行车自燃引起并造成财产毁损，那么车主对此是负有过错的，需要承担相应的民事赔偿责任。</span>

<strong><span style="font-size: 16px;"><strong>二、行政责任</strong></span></strong>

<span style="font-size: 16px;">《高层民用建筑消防安全管理规定》第四十七条明确：“违反本规定，有下列行为之一的，由消防救援机构责令改正，对经营性单位和个人处2000元以上10000元以下罚款，对非经营性单位和个人处500元以上1000元以下罚款：……（七）在高层民用建筑的公共门厅、疏散走道、楼梯间、安全出口停放电动自行车或者为电动自行车充电，拒不改正的。”第六十四条明确：“违反本法规定，有下列行为之一，尚不构成犯罪的，处十日以上十五日以下拘留，可以并处五百元以下罚款；情节较轻的，处警告或者五百元以下罚款：……（二）过失引起火灾的。”</span>

<span style="font-size: 16px;">根据《中华人民共和国刑法》第一百一十五条的规定：“放火、决水、爆炸以及投放毒害性、放射性、传染病病原体等物质或者以其他危险方法致人重伤、死亡或者使公私财产遭受重大损失的，处十年以上有期徒刑、无期徒刑或者死刑。过失犯前款罪的，处三年以上七年以下有期徒刑；情节较轻的，处三年以下有期徒刑或者拘役。”</span>

<span style="font-size: 16px;">根据《民法典》的相关规定，如果因为产品缺陷导致他人损害，被侵权人可以向产品的生产者请求赔偿，也可以向产品的销售者请求赔偿。因此，若火灾是由电动自行车的质量问题导致的，被害人既可以向电动自行车的生产厂家要求赔偿也可以向电动自行车的销售商要求赔偿，也可直接将生产厂家与销售商同时列为被告，共同要求赔偿。</span>
