<span style="font-size: 16px;letter-spacing: 1.5px;">事情要从去年5月讲起，当时的郑某某因无法履行还款义务被法院列为失信被执行人，在法院对其发出执行通知书和财产报告令后，<strong><span style="color: #c00000;">仍将其投保在某保险公司的保单的投保人变更为郑某某儿子，并由其儿子办理了退保，相关保单价值22万余元。</span></strong>同年12月，<strong><span style="color: #c00000;">郑某某涉嫌拒不执行判决、裁定罪被公安机关抓获归案。</span></strong></span>

<span style="font-size: 16px;letter-spacing: 1.5px;">2023年2月，该案移送乐清市检察院审查起诉。“我也欠了我儿子很多钱，我当时只想着先把儿子的钱先还上。”面对检察官的讯问，郑某某十分懊悔。经过细致的审查，检察官<strong><span style="color: #c00000;">认为郑某某对人民法院判决、裁定有能力执行而拒不执行，情节严重，依法应当以拒不执行判决、裁定罪追究其刑事责任。</span></strong></span>

<span style="font-size: 16px;letter-spacing: 1.5px;">在办理刑事案件外，检察官基于民事检察工作的办案经验，对该案涉及的民事执行卷宗材料进行了审查，并与执行法官沟通联系，核查是否还有可供执行的财产，做好追赃挽损工作。</span>

<strong><span style="font-size: 16px;letter-spacing: 1.5px;color: #c00000;">“郑某某名下有一辆被法院查封的奔驰牌轿车，但因车辆的隐蔽性、流动性强等原因一直未能实际扣押。</span></strong><span style="font-size: 16px;letter-spacing: 1.5px;">”检察官的审查有了突破，于是在随后与郑某某的沟通中，建议其主动交付车辆，积极履行还款义务。在检察官的释法说理下，郑某某态度积极诚恳，主动将其车辆开到市检察院。随后，在检察官的协同配合下，该车辆成功移交至市法院。</span>

<span style="font-size: 16px;letter-spacing: 1.5px;">2022 年以来，乐清市检察院以“数字赋能监督，监督促进治理”为指引，联合法院、公安等部门出台了相关工作机制，强化信息互通共享和执法司法协作，保障执行工作顺利有序运行，共同形成合力化解“执行难”问题。目前，通过上述机制，建议查封或协助查扣车辆20余辆，车辆执行查扣协作已形成一种常态化工作机制，切实维护了当事人的合法权益。</span>
